The creation of the Department of Education, along with the other myriad of 'alphabet soup' agencies, was never a power delegated to the Federal government by the Constitution. The 10th Amendment clearly says that these powers 'not delegated' by the Constitution, belong to the States respectively, or to the people. The creation of the Department of Education, along with the other myriad of 'alphabet soup' agencies, was never a power delegated to the Federal government by the Constitution. The 10th Amendment clearly says that these powers 'not delegated' by the Constitution, belong to the States respectively, or to the people.
